The Party Wall etc. Act 1996 provides a basis for preventing or resolving disputes in relation to party walls, party structures, boundary walls and excavations near neighbouring buildings. It is crucial that the right professional advice is obtained at the outset of a project as the Law requires procedures to be followed by both the building owner and adjoining owner in finite timescales.

If you are proposing works which are covered by the Act, you must give the adjoining neighbour notice of your intention in line with the Act.  If your neighbour disagrees then the Act provides the framework to resolve issues.

What it covers:

These are some typical examples of work that is likely to be covered by the Act:

  • Excavating for the foundations to a new extension within 3m of a neighbouring or shared structure.
  • Excavating for the foundations to a new extension within 6m of a neighbouring or shared structure at a lower level.
  • Installing steel beams into a party wall as part of a loft conversion.
  • Removing chimney breasts that are attached to a party wall.
  • Underpinning a party wall to facilitate a basement extension.

It is important that you find out whether that any proposed works fall within the Act. If it does, you must notify all Adjoining Owners prior to commencement of the works. If work starts without a notice being given, an adjoining owner can seek to stop the work through a court injunction or seek other legal redress.
